If Trump does not face legal consequences for the events of that day, he and his supporters have reason to believe that Trump somehow frightened the U.S. The incitement of violence by the head of the government is not an infraction that can be dismissed and forgiven by any political system that hopes to stay constitutional. An American president is bound by law and operates through legal institutions, but a president also has sources of personal authority that are not beholden to the law and are exercised outside institutions. No, leave the decision to the voters. The time for justice has come. Whatever happens with that run, his likeliest Republican rivals are studying his methods, considering which to emulate and which to discard. He has not repented or reformed in the two years since. To repeat McConnell’s phrase, it’s “practically and morally” very difficult to hold a wayward president to account. Again and again, they get the same answer: “It’s somebody else’s job.” By a vote of 81 million to 74 million, they repudiated Trump. They can identify who helped him, and who tried to dissuade him. As the introduction notes, Trump, beginning on election night, purposefully disseminated “false allegations of fraud…to aid his effort to overturn the election” (and to solicit what would end up being about $250 million in political contributions). The third referral for conspiracy to make a false statement was, according to the legal experts, an appropriate choice if the justice department could prove conclusively that Trump was part of the conspiracy to submit the fake electoral slates to Congress and to the National Archives. Although the select committee presented the third referral as straightforward, legal experts said proving that Trump was part of the conspiracy could prove tricky: they would have to show he was personally involved in the plot, and that he knew it was to be used to induce illegal acts by Pence. The second referral for conspiracy to defraud was another possible charge that is likely to be considered by federal prosecutors, the experts said, since it does not need to be connected to an underlying crime besides impairing a lawful government function through dishonest means.
