Dr. Lise Gotell, a women’s study professor at the University of Alberta and an expert on sexual assault law, said that the Supreme Court of Canada has not offered a clear opinion on whether someone who is heavily intoxicated can provide consent. “Even after consent is given, it can be retracted at any time, which means that a small video – whether it is six or 20 seconds – does not tell the whole story. This is a serious matter that she is mis [sic] representing and could have significant implications for a lot of people including you,” the player wrote at 12:06 p.m. “A six-second or 20-second video just is not enough to provide the context for what’s happened. I don’t want anything bad to come of it so I told her to stop,” the woman wrote at 11:53 a.m. Both lawyers for the alleged victim and seven former CHL players declined to comment on the videos and text messages. La femme s’est ensuite excusée pour « les troubles qu’elle aurait pu causer », selon le quotidien. « Le message qui est envoyé à l’élite, c’est “faites vos conneries et on va vous protéger avec l’argent du monde qui veut juste jouer au hockey !” ». « On savait qu’Hockey Canada avait payé des victimes plusieurs fois dans les dernières années pour qu’elles gardent le silence, et on constate maintenant que ces sommes viennent des poches du gouvernement et des parents qui veulent juste que leurs jeunes fassent du sport », s’insurge-t-il en entrevue. La fédération sportive a confirmé mardi l’existence d’un « fonds national d’équité » au sein de l’organisation, une information d’abord révélée par La Presse canadienne.

“Hockey Canada receives funding from various sources, including the federal government and from its members, who pay a fixed amount each year to participate in Hockey Canada’s insurance program,” Mr. Conway said. Nor did it respond to a question about whether Hockey Canada makes an effort to disclose the fund. It also settled on behalf of the eight unnamed players, in a situation that was never fully investigated, nor subjected to the scrutiny of an insurance company. Hockey Canada sought to have his affidavit deleted from the court record, and replaced by a new document sworn by different executives. According to information Hockey Canada provided to The Globe last week after being asked about the McCurdie affidavit, the organization now charges a fee of $23.80 per player in 2022. On the topic of alleged sexual assault, the executive indicated Hockey Canada also keeps a reserve fund to deal with cases on its own, in addition to carrying insurance. “And they settled not only on their own behalf, and on behalf of the Canadian Hockey Association, but on behalf of eight unknown John Doe players. As he detailed how extensive the organization’s coverage was, Mr. McCurdie said Hockey Canada carried comprehensive insurance for all sorts of liabilities, including injuries, and potential sexual assault claims. The fact that one of Hockey Canada’s first calls was to its insurer, rather than the police, has drawn criticism. The claim alleges the organization “perpetuated a toxic environment that condones violent and sexualized conduct, including sexual assault.” And by ignoring these problems, it allowed its employees, coaches and players to act with immunity and without fear of reprisal, the documents say. Nor is it listed in the organization’s handbook for parents and players, which describes how registration fees are spent on Hockey Canada insurance coverage, even though some of that money is channelled into the fund. Though Hockey Canada hasn’t said specifically where the money for the settlement came from, the reserve fund it uses to cover alleged sexual assault cases is also an investment account.

The detail was included in a July 2021 affidavit sworn by Glen McCurdie, who was then Hockey Canada's vice-president of insurance and risk management, as part of a lawsuit launched by an injured player in Ontario.

Now the scandal risks migration from an administrative body into the thing it administered. They just want you to put your hand up, admit you were to blame and go away. It has become so tangled that it can no longer see the only way out – clean, ruthless cuts. Nobody wants to hear you argue the fine points of corporate banking. The neighbours won’t let it go so you call a meeting and promise to do further, deeper investigating, possibly involving new dogs. You get caught using the neighbourhood’s yard-sale money to settle a debt. The fund was seeded in part using registration money paid by amateur hockey players across the country, from little kids to grown men and women. This was an off-the-public-books account that held money in reserve in order to pay out legal awards. Through no fault of your own, you might be implicated.
