Bannon à se conformer à la citation à comparaître émise par votre commission», ajoute-t-elle. Il faisait notamment partie de la «cellule de crise» dirigée par des conseillers de M. Trump depuis un hôtel de luxe de Washington avant et après l'assaut sur le siège du Congrès. Selon la lettre de Me Costello, M. Bannon a déclaré à la commission d'enquête que «les circonstances ont changé dorénavant». M. Bannon avait été inculpé en novembre 2021 d'«entrave» aux prérogatives d'enquête du Congrès et la date du début de son procès avait alors été fixée au 18 juillet. Même si M. Bannon n'était à l'époque pas employé par la Maison-Blanche et n'était plus un conseiller officiel de M. Trump, ses avocats avaient invoqué la protection du droit des présidents à garder certains documents et discussions confidentiels pour qu'il ne se présente pas devant la commission d'enquête en octobre 2021. Les enquêteurs estiment que M. Bannon et d'autres conseillers de M. Trump sont susceptibles de détenir des informations sur les liens entre la Maison-Blanche et la foule qui a envahi le Capitole ce jour là afin de tenter de bloquer la certification de la victoire de Joe Biden.

It’s an added bonus that we’re now reminded of just how deeply involved Bannon was in promoting and hyping Jan. 6 to his and Trump’s acolytes. Trump’s letter was more a case of admitting something that was already the case than him giving up any specific privileges. But that begs the question: Why would Trump, after spending years arguing for a nearly despotic view of executive power, yield on this front? There’s clearly a lot to unpack there, not least the former president’s ever-loose grasp on the niceties of the English language. Let’s take a close look at the letter Bannon’s lawyer sent to committee Chair Bennie Thompson, D-Miss., which was first reported by The Guardian. “Mr. Bannon has not had a change of posture or of heart,” Robert Costello wrote.

However, in a motion filed early Monday morning, the DOJ revealed Trump’s attorney, Justin Clark, said in an interview with the FBI last month that Trump had never invoked executive privilege for Bannon. Another attorney for Bannon, Robert J. Costello, cited a letter from former President Donald Trump that said he would waive his claim of executive privilege for Bannon to testify. Bannon refused to comply with a subpoena from the January 6 committee for months, arguing he could not produce documents or sit for an interview due to Trump’s claim of executive privilege, a legal doctrine which allows presidents to keep some internal communications secret.
