New charge against Jacob Hoggard surfaces as he awaits verdict in ... (CBC.ca)

A sexual assault charge relating to a rape allegation from June 2016 has surfaced against Jacob Hoggard, the former frontman for rock band Hedley.

CBC has not been able to verify if there is a record of her visit to the centre. She said some band and crew members may have seen her leave the hotel. He was very strong," said the woman. The woman said Hoggard wanted to know how old she was. She said she refused but that he urinated on her stomach anyway. After the concert, they hopped in a van that was taking fans to the Comfort Inn to party with the band. Once inside, the complainant saw several guitars and hoped she and Hoggard could "jam" together. She became drunk and said that's when Hoggard took her to his hotel room. On June 24, 2016, the woman attended a Hedley concert at the Joe Mavrinac Community Complex in Kirkland Lake with a family member. "We do not litigate cases in the media and this case is no exception. The complainant provided CBC with emails in which she asked police to release Hoggard's name. A verdict in the Toronto trial is expected soon.

1 hr ago 1 hr ago "I'm quite uncomfortable with this," Roberts said. Roberts ruled the complainant had no reasonable expectation of privacy when it came to the call, meaning it could be used without first holding a hearing. The new rules require the defence to apply in advance to introduce such materials, and grant complainants the right to participate in that hearing. Under law, evidence of a complainant's past sexual history, which can include sexual texts, is inadmissible unless there is an application to show it will only be used for limited, specific purposes. The second complainant testified, however, that some messages were of a sexual nature. The Crown was given permission before trial to introduce some evidence related to text messages between Hoggard and the two complainants. As a result, she said, the similarities are no longer significant and should not be given weight. Roberts ruled his evidence inadmissible. She was immediately cut off by prosecutors before she could elaborate. Hoggard's lawyer, Megan Savard, said Tuesday her client is innocent and denies the new allegation, and that he will plead not guilty.

Hoggard sent that video to one of the complainants, according to her testimony, and Crippin said he also received the video from Hoggard as an unwanted “locker room” joke. She also excluded some text messages in which Hoggard asks whether his limo driver should pick the 15-year-old complainant up from school in their initial attempt to meet, and another where he appears to reference that she is in Grade 10. She also found that Hoggard’s alleged interactions with the teen complainant — which could be considered grooming and deceitful — would not lead the jury to conclude he is a rapist, or make them want to convict him regardless. The Crown argued this evidence could be used to bolster the complainant’s credibility. The woman said she came forward to support the Ottawa complainant after her story was initially published by the CBC in 2018. Both complainants in the Toronto trial first came forward to police in 2018, about a year-and-a-half after the alleged sexual assaults took place. That she sent him nude photos is relevant to her assertion that she trusted him, Roberts said. He has pleaded not guilty to two counts of sexual assault causing bodily harm and sexual touching of a person under the age of 16. That woman testified she met the singer at the festival when she was 12 when he gave his cellphone number to her parents. He is also accused of groping the teen fan after a concert when she was 15. His lawyer argued both women fabricated their allegations because Hoggard used them for casual sex and they felt discarded and regretted the sexual encounter — a motive Superior Court Justice Gillian Roberts said outside the jury’s presence sounds like “a stretch.” According to court documents, Hoggard allegedly sexually assaulted the complainant in Kirkland Lake, Ont., on June 25, 2016 — just a few months before he allegedly raped the two complainants in his current trial.

Jury deliberations in earlier case against Hoggard have begun, meaning new charge can be made public.

The younger complainant said Hoggard pushed her face into the pillows, making it difficult for her to breathe. The second complainant, meanwhile, said he choked her hard enough to make her fear for her life. He agreed the spitting, slapping, name-calling and request for urination may have happened because those were among his sexual preferences. Both complainants have testified they cried and said no throughout the encounters. He has pleaded not guilty to all charges. But jurors there have now begun their deliberations, meaning the new charge can be made public.

It is entirely subjective in nature,” she said, quoting from the appeal decision. They allege the complainants lied about being raped to cover up their embarrassment after being rejected by a “rock star.” Prosecutors say jurors should consider the similarities as indicating a pattern of behaviour.

TORONTO — Jurors are to continue their deliberations today in the sexual assault trial of Jacob Hoggard, the lead singer of the Canadian band Hedley.

Prosecutors allege the singer violently and repeatedly raped a teenage fan and a young Ottawa woman in Toronto-area hotels in the fall of 2016. Hoggard, who is 37, has pleaded not guilty to two counts of sexual assault causing bodily harm and one of sexual interference, a charge that refers to the sexual touching of someone under 16. Deliberations began Tuesday afternoon and jurors returned later with questions, including several related to what constitutes a position of authority for the purpose of establishing consent to sexual activity.
