Canadian women have right to an abortion, Trudeau says. But it's ... (CBC.ca)

While there are no laws barring women in Canada from having an abortion, it's also not considered a constitutionally protected right under the Charter of ...

You were subject, sometimes, to interviews and questions about the reason why you were having an abortion," explained Roxanne Mykitiuk, a disability and bioethics law professor at York University's Osgoode Hall. "It didn't really establish an abortion right," Bernard Dickens said. Since then, no government has attempted to introduce similar legislation, meaning Canada has no laws governing abortion. The issue certainly comes up during federal election campaigns. Wade abortion case prompted Prime Minister Justin Trudeau to assure Canadian women that their rights are well protected. "It could be that if the [U.S.] Supreme Court consolidates the draft judgment, it will have people coming from the U.S. to Canada," he said. "So I think that Section 7 has evolved now to a point where if it was presented to the court, they would say, yes, there's a constitutional right to have an abortion." But since 1988, subsequent rulings by the court, not related to the abortion issue, have backed up the idea that abortion is a guaranteed right, Gilbert said. But that case was not about whether abortion should be a guaranteed right; it instead focused on a narrow aspect of the procedure — and that aspect was found to be unconstitutional. In a 5-2 decision, written by Chief Justice Brian Dickson, the court ruled that Section 251 of the Criminal Code was unfair, and that it violated Section 7 of the charter, which guarantees the right of life, liberty and the security of the person. Wade would mean that, in regards to abortion, Canada and the U.S. would on the surface be similar — in that neither country would have a Supreme Court case enshrining the right to abortion. That's because, technically speaking, no Supreme Court in Canada has ever said in a majority decision that a woman has the constitutional right to an abortion, said Daphne Gilbert, a University of Ottawa law professor who specializes in criminal and constitutional law.

As we move westward into the U.S. Midwest, that’s where we see pockets of states that will fall when Roe v Wade falls,” he added. Speaking with reporters on Wednesday, Mendicino said people in the U.S. may be feeling doubt about whether they will be able to access abortion if Roe v. That means her job is helping people who need abortions access them. Wade, while experts are also raising the possibility that for Americans close to the Canadian border, this country could become their nearest safe haven.

A week before the April 29 application deadline, he said he was still short C$175,000. Canada's top court is unlikely to re-criminalize abortion any time soon. Ostensibly, since then, abortion has been a medical procedure like any other. Canada's Supreme Court decriminalized abortion in a historic 1988 ruling. The court on Tuesday confirmed the authenticity of the leaked document. Every woman in Canada has the right to a legal and safe abortion," Trudeau told reporters before a meeting of Liberal lawmakers in Ottawa. A draft U.S. Supreme Court decision, leaked late on Monday, showed a majority of justices prepared to overturn the 1973 Roe v.

Abortion is decriminalized in Canada because of a 1988 Supreme Court decision here, but no bill has ever been passed enshrining that right into law. Prime Minister Justin Trudeau says his government is looking at using legislation to ensure a woman’s right to a safe and legal abortion will be permanently protected in Canada. His comment comes two days after an unprecedented leak of a draft decision from the United States Supreme Court that would strike down the right to legal abortions in that country and leave it up to state governments to make abortion laws.

Wade, as the U.S. case has no direct bearing on Canadian jurisdiction. He said he’s also tasked the ministers of health and women and gender equality to “to look at the legal framework that exists around reproductive health and services like abortion to ensure that we move forward as necessary on ensuring that not just under this government, but under any future government, the rights of women are properly protected.” But one Conservative senator said Wednesday that in his view, the matter is settled in Canada and should be left alone. The promises included regulations under the Canada Health Act so “there is no question that no matter where someone lives, that they have access to publicly available sexual and reproductive health services.” What that action will look like was under scrutiny Wednesday in the wake of a leaked draft of a U.S. Supreme Court decision that appears set to roll back abortion rights in that country later this year. OTTAWA — Prime Minister Justin Trudeau says his government will act to ensure Canadians have access to abortion no matter where they live in the country, and also ensure that no future government can take that right away.

The U.S. Supreme Court could be poised to overturn the 1973 landmark decision legalizing abortion in the United States, according to a leaked draft opinion ...

“Pro-life advocates in Canada are now encouraged to work even harder,” Jeff Gunnarson, president of the antiabortion group Campaign Life Coalition in Canada, said Tuesday in a statement. Before the pandemic, Ontario, which lies along the Great Lakes region, referred around two dozen women a year to the United States for abortions that they were unable to locally access. The situation is starkest in New Brunswick province, which borders Maine and does not have a single abortion clinic. “We’ll never back down from protecting and promoting women’s rights in Canada and around the world.” People from rural areas seeking the medical procedure may have to travel several hours and pay extra if they are outside their area of health-care coverage. U.S. citizens in Canada are already able to access abortion services, either through Canada’s health insurance programs or, if they do not qualify, by buying private insurance or paying out-of-pocket. Trudeau on Wednesday defended his government’s support for reproductive rights, saying his administration has sought to close the access gap and is exploring possible legal changes “to ensure that not just under this government, but under any future government, that the rights of women are properly protected.” While there are not large numbers of Canadians traveling across the border for abortions, the U.S. option has provided Canadians one key alternative — and, both supporters and critics say, has been a crutch for lawmakers not seeking a change to Canada’s status quo. I’m very concerned about what this means, particularly for American women, but also for Canadian women.” Last July, Trudeau’s government withheld around $110,000 in health-care transfers to the province because of New Brunswick’s abortion restrictions and “failure to keep up its obligations under the Canada Health Act,” the prime minister said. “Every woman in Canada has a right to a safe and legal abortion,” Canadian Prime Minister Justin Trudeau tweeted Tuesday in response to the Politico report. Canadian Minister of Public Safety Marco Mendicino told Canadian media Wednesday that he was in touch with the Canada Border Services Agency to ensure the guidelines are clear for any U.S. citizen coming to Canada for the procedure.

Canada offers abortion to U.S. women if Roe v. Wade is overturned (Macleans.ca)

Politics Insider for May 4: Doug Ford leads the pack; MPs debate lowering the voting age to 16.

By the same token, neither party seems poised to collapse sufficiently and help the other defeat the Tories in key ridings. Poilievre is a gleeful arsonist throwing Molotov cocktails at heaps of dry ideas and can’t be bothered waiting around to see the result. In Canada, our access to abortion has not faced the same political pressure as in the United States. That does not mean we should take our eye off the ball. Neither (Steven) Del Duca, who was never a particularly impressive minister, nor (Andrea) Horwath, who has led the NDP for 13 years and could only parlay the Liberals’ epic unpopularity in 2018 into official opposition status, seem poised to grab people’s attention and run with it. It remains reasonable to ask how much of that is finding a home in the current Conservative party, vulnerable as it apparently is to social conservatism and leadership aspirants who are getting giddy highs from trashing Canadian institutions like, say, the Bank of Canada or government “gatekeepers.” It’s a sight to see, but watch out for the droppings. And as Ontario’s political geography shifts, that can impact Canada’s political geography. Karina Gould said Tuesday that American women will be able to obtain abortions in Canada if the United States Supreme Court overturns Roe v. Wade and states restrict access, CBC reports: “I don’t see why we would not.
