Michalski tried to kill himself by lying on train tracks on February 28, 2021, the same day that Gerace was arrested and indicted. Judge Michalski recused himself from a car crash case involving Gerace in 2019 because of the pair's relationship. She worked there before marrying Gerace. 'Before I was with him, I had an adult store inside and I worked there. Katrina Nigro was married to Gerace for four years. His cases were reassigned last month after the raid on his home. Judge Michalski, who earned $210,900 a year, tried to kill himself after Gerace was indicted last year. Michalski tried to kill himself February 2021 by lying on train tracks in the middle of the night. The judge was named an acting state Supreme Court justice in 2006. A law enforcement official told the newspaper: 'They were looking for evidence of tax crimes. He laid down on train tracks near Buffalo but survived with a seriously injured leg. The circumstances of his death remain unclear. Michalski knew Gerace for decades and had done legal work for him.

John Michalski, an acting justice on the Erie County Supreme Court, died of an apparent suicide, according to attorney Terry Connors. Michalski was 61.

Connors said there had been a groundswell of support for Michalski upon news of his death. A Department of Justice spokeswoman said in an email Wednesday that the agency does not confirm or deny investigations. He was hospitalized with a serious leg injury. He appeared "to be doing well. His apparent suicide attempt last year came on the same day that a former client and family friend, Peter Gerace Jr., was arrested by federal agents in Florida. Gerace, the owner of a strip club near Buffalo and the nephew of an alleged Buffalo mob boss, was indicted on charges related to drug and sex trafficking and bribery of a former Drug Enforcement Administration agent. Michalski, appointed to the bench in 2006, had returned to his duties in January after going on medical leave in the wake of an apparent suicide attempt in February 2021, Connors said.

A western New York judge who reportedly laid on railroad tracks last year and waited for a slow-moving freight train to pass over him has died by suicide.

WIVB reported that “federal authorities had questioned Michalski on his relationship with Peter Gerace.” After the railroad incident, Michalski’s caseload was reassigned, but it was eventually reinstated, the New York Times reported. “The defendant BONGIOVANNI’s friends and associates who were involved in possession, use, and distribution, and importation of controlled substances, included, among others, individuals he believed to be members of, connected to, or associated with Italian Organized Crime (IOC) in the Western District of New York and elsewhere,” the document continued. “It’s a very small consignment business, selling jewelry, clothes and various knickknacks on eBay,” Lana told the newspaper. On February 28, 2021, the owner of Pharaoh’s Gentlemen’s Club in Buffalo, New York was arrested in Florida following a superseding Indictment charging him with one count each of bribery of a public official, conspiracy to defraud the United States, maintaining a drug involved premises, conspiracy to distribute controlled substances, and conspiracy to commit sex trafficking. A hospital told WIVB that Michalski suffered a “serious leg injury.” “In fact, Michalski married Gerace and his former wife, Katrina Nigro, in September 2014, according to the marriage certificate.” The highest court in New York is called the Court of Appeals. WIVB sued after it received only a heavily redacted police report and no official video regarding the incident. The TV station only broadcast some of it because the judge was injured when a freight train passed over him. Another Michalski attorney, Terrence Connors, told the New York Times that “it would be difficult to find a judge who was more respected” in western New York State. Connors was described as a “longtime friend” to the judge. The New York Times said Michalski was found dead at his home. Buffalo NBC affiliate WGRZ spoke with Nigro in 2021.
