Judge delivers partial sentencing verdict while awaiting Supreme Court decision on consecutive sentences for cases with multiple murder victims.
"Given the purpose of these proceedings, the focus has been how Krissy, Roy and Vana's lives tragically came to an end," he said. Leibovich ended his statement by remembering the victims and quoting the positive things their loved ones had to say about Krissy, Vana and Roy. In his decision, Leibovich pointed out that Fenn refused to participate in the pre-sentencing report. Leibovich determined that the attack on Vana was a separate incident that occurred several hours after the other two murders. Leibovich indicated he would impose a consecutive sentence in Vana’s death if the Supreme Court allows it. The second-degree murder convictions carry a life sentence and as a result Superior Court judge Howard Leibovich was left to decide the length of time before parole eligibility.
